1. Acceptance By accessing or using Emergences Labs' services — including emergences.ai, NeoHuman, and any related products (collectively, "the Services") — you agree to these Terms. If you don't agree, please don't use the Services.

2. Use of the Services You agree to use the Services only for lawful purposes. You may not reverse-engineer, copy, resell, scrape, or abuse the Services, interfere with their operation, or use them to circumvent any of our assessment, proctoring, or integrity controls.

3. Accounts and Access You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to provide accurate information and to notify us at contact@emergences.ai if you suspect unauthorized use.

4. Commercial Terms Access to commercial features — including enterprise assessment programs, NeoHuman seats, custom datasets, and research collaborations — is governed by a separate agreement between Emergences Labs and the contracting customer. Pricing, billing, and service commitments are set out in that agreement. Use of public marketing pages, published research, and open benchmarks remains subject to these Terms.

5. Intellectual Property All intellectual property in the Services — including software, designs, content, benchmarks, datasets, and brand assets — is owned by Emergences Labs or licensed to us. Nothing in these Terms transfers any of those rights to you.

You retain ownership of work products you submit through the Services (for example, assessment task outputs, portfolio submissions, or research materials). By submitting them, you grant Emergences Labs a worldwide, non-exclusive license to process, store, and display them as needed to provide the Services and to generate the evaluation reports requested by you or your authorized employer. Any further use — for example, anonymized inclusion in training or benchmark datasets — requires your separate, explicit consent.

6. Assessment Integrity If you use NeoHuman or any Emergences Labs assessment, you agree not to tamper with the capture or proctoring systems, share session credentials, or fabricate evidence. Doing so may invalidate your results and may be reported to the party that commissioned the assessment.

7. Privacy Information collected through the Services — including session captures during NeoHuman assessments — is handled in accordance with our Privacy Policy. Please read it carefully.

8. Disclaimer The Services are provided "as is" and "as available." We do not warrant that the Services will be uninterrupted, error-free, or fit for every purpose. To the maximum extent permitted by law, Emergences Labs is not liable for indirect or consequential damages arising from your use of the Services.

9. Changes to These Terms We may update these Terms from time to time. The updated version will be posted here, and for material changes we will provide reasonable notice. Continued use of the Services after an update means you accept the revised Terms.
